Preamble

The present conditions of sale are concluded, on the one hand, between Bunnicuts, micro company siren 878 212 646 00011, located 75 rue du Gosset, 62400 Locon, France and, on the other hand, by any person, hereinafter referred to as the “Customer”, wishing to proceed with a product purchase.

The terms and conditions of sale are governed exclusively by French law.

The payment of the order by the Customer constitutes acceptance without reservation of these General Terms and Conditions of Sale.

All products offered are governed by international copyright laws and copyrights. Any reproduction, even partial, of the site and products is formally prohibited.

Article 1 – Purpose

The purpose of the present General Terms and Conditions of Sale is to define the rights and obligations of the parties in the context of the online sale of goods offered by Bunnicuts to the customer.

Article 2 : Prices

Prices are indicated in Euros or calculated automatically in any other currency and calculated excluding taxes and excluding processing and shipping costs. They are not increased by the rate of VAT, the status of micro-company implying an exemption of VAT, according to Article 293 B of the CGI

The company Bunnicuts reserves the right to change its prices at any time, depending on economic or regulatory conditions. Invoicing is carried out according to the tariff in force on the day of the order. All prices are given subject to obvious typographical error.

For any particular customer request, an estimate will be sent by email.

The products remain the property of the Bunnicuts micro-company until the delivery of the products.

Warning: as soon as you take physical possession of the products ordered, the risks of loss or damage to the products are transferred to you.

Article 3 : Products

The company endeavours to give as many details as possible on the articles offered in the shop in compliance with article L 111-1 of the French Consumer Code, which provides for the possibility for the potential customer to know, before taking a final order, the essential characteristics of the products he wishes to buy.

The photos of the articles represented on the Bunnicuts shop and website are non-contractual and are subject to change at any time. The company cannot guarantee a perfect similarity with the article ordered (depending on the lighting during the shooting but also on the resolution and calibration of each person’s computer screen). Consequently, Bunnicuts cannot be held responsible for a marginal difference between the colours displayed and the colours of the product as delivered as well as for the texture of the paper.

The manufacturing processes used by Bunnicuts (cutting, watercolouring etc.) are not guaranteed to be identical. Being hand-crafted processes, each copy may be slightly different from the others and the finished products may have slight imperfections without constituting a defect.

Article 4 : Payments

The price is due when the order is placed. The order is processed only upon receipt and validation of payment, which can be made, by Paypal or by credit card via our secure payment module Stripe. In the latter case, the customer’s banking information is never communicated to the Bunnicuts company, but processed directly by the bank’s secure and encrypted server. In order to fight against credit card payment fraud and depending on the amount of the customer’s order, the company Bunnicuts may ask the customer for proof of identity and domicile.

Failure to pay will automatically and without formality lead to the cancellation of the said order.

Article 5 : Order

The visitor can browse freely on the online shop without being committed to an order. If the visitor wishes to place an order, he will select the product(s) chosen by clicking on the “Add to cart” button. The visitor will have to fill in exactly the information requested in order to identify him/her: surname, first name, e-mail address, postal address.

After having read the status of his/her order and once all the information has been completed, the visitor will receive a summary of this information and the order placed. To access the secure payment site, the visitor will have to click on “Pay my order” to definitively confirm his order.

As soon as the payment is validated, the order is recorded and the visitor becomes the buyer. The order form will be recorded on Bunnicuts’ computer registers and will be considered as proof of the contractual relationship between the seller and the buyer.

Article 6 : Creation delay

The product is created after receipt of payment. The average creation time is 3 days. It can take up to 7 working days depending on the period. In the event of a manufacturing delay after placing your order, we will inform you by e-mail or by mail and a manufacturing time will be announced.

Article 7 : Customized Orders

On receipt of an order with customization, the designer undertakes to make a quote within 5 working days. It is then understood that the customer must validate the visual sent before any manufacture and this to avoid any error.

After validation the sending is done within 48H via Delivengo by La Poste in protected parcel to avoid any breakage during the sending with tracking.

In accordance with the French law, and by exception that it is made in accordance with the provisions of Article L 121-20-2 of the French Consumer Code, products that are “customized” will not be refunded and do not benefit from a withdrawal period of 7 days after confirmation of the visual.

Article 8 : Shipping

8.a Delivery is made to the address that the customer has indicated when ordering. For any error in delivery information communicated when placing your order, Bunnicuts invites you to contact us within 24 hours at [email protected].

The delivery costs are fixed and indicated at the time of placing the order. 

All international orders are sent via Delivengo by La Poste, in a protected package to avoid any breakage during dispatch.

8.b Each shipment has a tracking number sent by e-mail allowing the customer to follow the routing of his goods. For information, the transit time of your package is more or less 15 days for international shipping. After this period and after having checked your parcel tracking, we invite you to notify us by email at [email protected] to inform us of the concern for delivery.

We will then contact Delivengo by La Poste to start an investigation. An investigation La Poste may last up to 21 days from the date of the investigation. If during this period, the product is found, it will be rerouted immediately to your home (the majority of cases). If on the other hand the product is not found at the end of the period of 21 days of investigation, La Poste considers the package as lost. Only then can we send you a replacement product, at our expense.

In the event of a new delivery due to an error on the part of the customer (for example: address error, incomplete address, unclaimed parcel, etc.); redirection will be invoiced to the customer.

8.c The customer having received a parcel presenting no apparent defect, but realizes at the time of the unpacking of the order that a frame is damaged or that a glass is broken (or other), it will suffice to address an email with photo of the product presenting the defect as well as the order number and specifying which part of the order is damaged (in case there are several in the order) to: [email protected]. After-sales service will only be taken into account on receipt of these elements, a quick and effective response will be sent to the buyer with the procedure to follow.

Any request must be made 72 hours after receipt of the goods, after this period, no complaint will be taken into account and your order will be considered compliant.

Article 9 : Complaint, withdrawal period and reimbursement

In accordance with Articles L. 120-20 fo French Law, the customer has a period of fourteen (14) calendar days to return, at his expense, products that do not suit him that are not “tailor-made”. This period runs from the day of receipt of the customer’s order. A request must be made by e-mail to [email protected], an acknowledgment of receipt will be sent to you. The product must be returned to the address: Bunnicuts, 75 rue du Gosset, 62400 Locon, France.

In accordance with the French law, and by exception that it is made in accordance with the provisions of article L 121-20-2 of the French Consumer Code, the products which are “customized” cannot be refunded and do not benefit from a delay of withdrawal 7 days after confirmation of the visual.

The delivery costs of the order will not be reimbursed and the costs of returning the product following a withdrawal remain the responsibility of the customer.

The article to be returned must be intact, complete, packed identically in its original packaging upon receipt at our premises. Otherwise, a photo will be sent to you and reimbursement will not be made. We can not be held responsible in case of breakage by the carrier chosen by the customer, for the return product.

The refund will be made within 48 hours after receipt of the return of the product if it has already been shipped, or 48 hours after validation of the order if the product has not yet been shipped, excluding bank processing times.

Article 10 : Disputes

The general conditions of sale and the contract are governed by French law. In the event of a dispute or complaint, the buyer will first contact Bunnicuts to obtain an amicable solution. If no solution is found, only the French courts will be competent.

Article 11 : Responsibility

Bunnicuts, in the online sales process, is only bound by an obligation of means; its responsibility could not be engaged for a damage resulting from the use of the Internet network such as loss of data, intrusion, virus, breakdown of the service, or other involuntary problems.

Article 12: Propriété intellectuelle

Nul n’est autorisé à reproduire, exploiter, rediffuser, ou utiliser à quelque titre que ce soit, même partiellement, des éléments du site qu’ils soient logiciels, visuels ou sonores. Tous les droits de ce site et de son contenu sont réservés à travers le monde. Toute autre utilisation des modèles, dessins, logos, photos, objets et images, telles que reproduction, commercialisation, diffusion et édition par quiconque est rigoureusement interdite et constitutive d’une contrefaçon pouvant être sanctionnée pénalement et civilement.

Article 13 : Computing and Freedom

In accordance with the French law n ° 78-17 of January 6, 1978 relating to data processing, the files and freedoms, you have a right of rectification, consultation, modification and deletion of the communicated data. You can exercise this right by sending us an email to [email protected]. All your personal data will only be used to process your orders and will never be disclosed to a third party.
